Phil Pavlov and the Constitution

It is obvious by the recent acts of Mr. Pavlov that he and his Republican colleges have no regard for the constitution of the state of Michigan.

First, he voted for a bill that would have legalized bullying. This is the language from the original bill passed by the senate: “This section does not prohibit a statement of a sincerely held religious belief or moral conviction of a school employee, school volunteer, pupil, or a pupil’s parents or guardian.”

The Michigan Constitution Section 41 clearly states: The Legislature shall not diminish or enlarge the civil or political rights, privileges and capacities of any person on account of his opinion or belief concerning matters of religion.

This clause in the law passed by the senate clearly violates the constitution because it does enlarge the civil and political rights of a person on account of their religious opinion or belief.

Second, Mr. Pavlov was the sole sponsor of SB 865 which would narrowly change Public Act 4, the Emergency Financial Manger Law, enough to invalidate the current referendum petition. A sneaky attempt to circumvent the voters’ constitutional rights to place a law up for a ballot referendum.

The Republican led house and senate have also implemented a rarely used loophole in several laws, one being the pension tax, that if the bill includes a cash appropriation as part of the bill to implement the law then it is immune to voter referendum.

Why is Michigan being turned into a fascist state… where are our rights?

If successful in their effort, St. Senator Pavlov would be the second sitting elected Michigan Legislative member to be moved from office in the past year. With the first being former Representative Paul Scott (fr. R-Grand Blanc).
