Homeowner justice prevails, as Florida property owners foreclose on bank for legal fees

Property owners seize Bank of
America in Florida assets, over
mistake case of home foreclosure,
to pay attorney's legal fees. 
Its' citizens justice for the common citizen homeowner against the big, bad corporate privately funded bank.


It is how foreclosure defense lawyer Todd Allen described the sensation of walking into a branch of Bank of America in Naples, Florida, to seize their property, on a news story detailed by WFMY-Channel 2 of North Carolina.


Faced with a pair of sheriff's deputies locking their properly, handed over a check for $2,534, instead. This amount was to cover Allen's cost from a case where he represented clients that the bank has tried to seize property - despite the fact they paid for their home into cash.
"They've ignored our calls, ignored our letters, legally this is the next step to get my clients compensated, " attorney Todd Allen stated.

News-Press.com in Fort Myers, FL reported on June 3rd, that Bank of America opened their case against Warren and Maureen Nyergers in February 2010, voluntarily dropped it two months later, but never returned the couple's legal costs as ordered by a judge.


Station WFMY provided the insight on how justice was served:
"Sheriff's deputies, movers, and the Nyergers' attorney went to the bank and foreclosed on it. The attorney gave instructions to to remove desks, computers, copiers, filing cabinets and any cash in the teller's drawers. After about an hour of being locked out of the bank, the bank manager handed the attorney a check for the legal fees."
